The Valley Chapter meeting was interrupted for the Region II meeting.
Randy Beintema called the Region II meeting to order at 1925 hours.
1. Nominations open for Region II, Central Chapter Director
Motion was made by Mike Cavellero to nominate Mingo Camit. Second by Ron Durant. Motion carried.
No further nominations, motion to close nominations by Greg Simpson, Second by Mark Smith. Motion Carried.
2. Nominations open for Region II LDF Trustee.
Motion by Ron Durant to nominate Andy Schlenker. Second by Paul Brown. Motion carried
No further nominations, motion to close by Mike Cavellero. Second by Mark Smith. Motion carried.
3. Nomination open for Region II I&B.
Motion by Dave Souza to nominate Dave French. Second by Paul Brown. Motion carried.
No further nominations, motion to close by Joe Schmidt, second by Vern Gladney. Motion carried.

V. Approval of Minutes
1. Motion by Beintema to accept minutes of August meeting, second by Brown, Motion carried.
VI. Treasurer's report
1. Paul Brown presented report, Valley Chapter account balances: General acct - $16,263.99; PAC Acct - $31,956.89. Motion to accept report by Beintema, second by Zelinsky, motion carried
VII. Old Business
1. Mark Smith brought up that the request for endorsement made in the August meeting for Alan Cassidy for Stanislaus County Superior Court Judge, was made in error. Cassidy was already endorsed by the Valley Chapter in November of 2001. Motion was let die.
2. Proxy vote forms will be mailed to associations.
VIII. New Business
1. Mark Smith brought up a loop hole in PERS that may be causing spouses of safety members killed in the line of duty to loose benefits. Prior law forced spouses of safety members killed in the line of duty to make an option for their PERS retirement benefits. If they wanted to keep the benefits if they remarried they had to select a 25% reduction in benefits. If they didn’t want to keep the benefits upon remarriage they could select the full benefit. The PERS remarriage penalty was removed by law several years ago and all spouses who selected the 25% reduction were given the 25% benefit back. However, any spouse who had not taken the deduction, and had in fact remarried and lost their benefits, was now eligible to get those benefits back, however, they were required to contact PERS to reinstate the benefits. The law didn’t require PERS to attempt to locate these spouses who may have been cut off from benefits. There was no date limit in the law so it’s possible spouses of officers killed back in the 50's or 60's may still be alive and eligible for reinstatement. Many of these spouses may not know they are entitled to start receiving their PERS benefits again. Associations should attempt to locate spouses of deceased officers from as far back as possible and ensure they are still receiving their PERS benefits, or ensure they know to file with PERS to start receiving them again.
2. Clancy Faria brought up the Rusty Arias fund raiser in Modesto and asked people to attend if possible.
3. Chris Trussison made a motion to endorse Barbara Kromlund for Superior Court Judge in San Joaquin County. Second by Zelinsky. Motion carried. Trussison made a motion to donate $1,000 to Kromlund’s campaign. Second by Schmidt. Motion carried.
4. Mark Smith made a motion to donate $1,000 to the campaign of Alan Cassidy for Judge. Second by Beintema. Motion carried.
5. Nomination were opened for the board of directors of the Valley Chapter of PORAC for an election be to held at the October meeting. The following nominations were made:
President: Doug Ridenour nominated by Mark Smith, second by Beintema
Vice President: Dave Souza nominated by Matt Zelinsky, second by Schmidt
Treasurer: Paul Brown nominated by Mark Smith, second by Greg Simpson
Secretary: Mark Smith nominated by Paul Brown, second by Greg Simpson.
Nominations were closed.
IX. Reports
A. PAC
1. Clancy Faria spoke about the state budget. Pointed out that next years’ budget is going to be worse. Stated we were able to keep most of COPS funding and other law enforcement programs for this year. Stated that the retirement DROP bills are on the governors desk and he should sign them. (Later note: The governor vetoed the DROP bills). Reported that PORAC switched their active oppose position on DA and Public Defender safety retirement to neutral after some changes were made in the bill. Reported that 16 PORAC sponsored bills were on the governors desk. Reported about attempts to raid POST funds. Also reported on media attempts to access all peace officer training files.
2. Mike Ervin discussed the Inglewood incident.
B. Insurance and Benefits
1. None
C. LDF
1. Mike Ervin discussed Inglewood POA’s limited membership with PORAC with no LDF coverage. They now joined LDF.
D. Service Providers
1. Mastagni spoke of new cases they were handling for Sacramento POA.
2. Paul Goyette spoke of a case involving a correctional officer that they handled and got aquitted.
3. Rocky Lucia reported on the status of the "Riders" case in Oakland.
E. Association reports
1. None
X. Good of the Association
1. Clancy Faria spoke of an Exitor Police Officer who was struck by a DUI and lost both legs.
2. Steve May of Modesto PD still in a coma.
3. Mike Ervin and Clancy Faria addressed the meeting about their running for PORAC President.
4. Paul Heckman and Kip Ringen addressed the meeting about their running for PORAC Vice President.
