By-laws Committee - The Bylaws Committee met prior to tonight's meeting. The committee has been "working feverishly" on the bylaws. We would like to submit the bylaws to PORAC Counsel no later than June and vote on them at the August meeting.

    Ron Cottingham (PORAC President):
    Adam's Law - Tonight we are here to take care of business that we had hoped to take care of months ago. Tragedy struck the Steve Williams family when their son was killed by a drunk driver. The Williams family wanted to do something for their son and all others on the road. As a result of the relentless efforts of the family, AB3045 has made it to the Governors desk and was signed into law. This law increases penalties and will require an ignition interlock be installed on all second offenders. DMV will be in control of this program.

    On behalf of PORAC I would like to present Steve Williams and his family with a signed copy of AB3045 for their perseverance through this tragedy.

    • Steve Williams - Expressed his hopes that this bill will save someone's life. On behalf of his family, he thanked PORAC and the Valley Chapter for sticking with them throughout the process.

    PAC/OGA (Randy Perry):
    Status of New Year - The new year has started and all of the bills have been officially printed. There are almost 3000 bills to read and we are in the process of doing that now. At current time, we have approximately 12 bills that PORAC is sponsoring, in addition to a large number of bills we are actively supporting.

    • Kill Bills - For those who are familiar with Copely, a case came down regarding open meeting issues in a suit dealing with the privacy of law enforcement records. Copely came down and said any meeting with information on peace officer records cannot be made public. There are now two separate bills that have been authored by Mark Leno and Gloria Romero which hope to take these law enforcement privacies back to pre-Copely. We need to kill these bills.
    • Governors Commission on Benefits - The Governor announced the creation of a committee to look at benefits and GASB45 issues. This committee is a 12 person committee, of which 6 members will be selected by the Governor, 3 members will be selected by the speaker and 3 members will be selected by the senate president pro-tempore. PORAC President Ron Cottingham was selected as one of the 12 commissioners to sit on the commission.

    Gary Messing (C,B &M):
    Prison Inmates - We have sued the Governor for shipping off inmates to other states. This action affects everyone in this room ,as the prisoner overflow is dumping criminals out on the streets. We need to search for long term solutions. We will probably look to PORAC for assistance when this hits the appellates.

    Spielbauer- Most of the attorneys in this chapter agree with the position of Santa Clara County on this topic, however, there are other attorneys statewide who side with Spielbauer.

    • Ron Cottingham - There is an issue to take this case to the Supreme Court. PORAC has received split reactions to this issue. We are currently trying to address the dilemma this has created, as to how we will proceed. Lybarger does not grant true immunity, despite this common belief. We now need to decide how we will proceed and what PORAC will ask the court to do. We may simply have PORAC stay out of the issue. We have a short window and a decision needs to be made.
    • Gary Messing - We need Lybarger.
