OPEB Report- The report on public retirement has been submitted for public review. It is over 300 pages in length. PORAC is in the process of deciphering the contents of the report. Overall, it was not a negative report and there were no major findings that we did not know existed already. As a result of the report, Kieth Richman has pulled his initiative (which he was unable to gather appropriate signatures for) and has changed his tactics a bit. He vows to continue his efforts in pension reform.

Randy Beintema:
Out of State Organizations- Currently, out of state police organizations, such as National Fraternal Order of Police is actively trying to recruit membership into their organization. Some of these organizations are trying to entice new members by offering legal defense and labor negotiations for a very inexpensive monthly membership fee. Please keep in mind that you get what you pay for when and that cost will come in the form of lesser legal defense and labor relations programs. PORAC is the largest and best legal defense in the nation and understands the unique atmosphere of those tasks that California presents.

Weingarten Rules- There is a recurring trend in law enforcement where officers are getting called into IA hearings and being told that they are being instructed to speak as witnesses in IA matters. When the officers say they want representation, the IA officers inform them that through POBOR, they are not entitled to have representation when they are called as a witness. This is something that IA officers are instructed during their schooling. In this case, there is a law out there called Weingarten, in which you are protected by. Essentially, through Weingarten, if at any time you feel that you are being called and something you say leads you to believe that discipline could result from your being interviewed as a witness, you may request representation and cannot be denied that representation.

Stockton Unified Contract Negotiations- Stockton Unified Schools POA just recently ended a successful contract negotiation. As part of a three-year contract, they will receive PERs Public Safety 3%@50 formula and a 14% pay increase. They will also receive any COLAs that are handed down by the state throughout the duration of the contract.

Paul Brown (Sacramento POA):
New Police Chief- On January 09, new police chief Rick Braziel was sworn in. This is a positive move for the department. He comes in with huge budget woes looming and will have his work cut out for him.

Arturo Venegas- Last year I reported that a delegation from the Sacramento POA went to New Jersey at the request of police officers in Camden to assist in getting rid of our former police Chief Arturo Venegas. He was brought in to run the Camden, New Jersey Police Department when it was taken into receivership. I am pleased to announce that our efforts were successful and just recently, the Attorney General ousted Venegas. He is already looking to move on to another agency somewhere in the United States. Sacramento POA will remain active in assisting other POAs who are affected by him.

William Cho (Grant Schools POA):
Possible Dissolution of Department- Grant Unified has now merged with several other local districts, which has greatly increased the patrol and response area of our department. As a result, Grant Schools Police Department operates almost as a general service law enforcement agency, in that we are responding to home burglaries and calls for service that are not necessarily part of normal department operations. This is largely due to the fact that homes in the more rural areas are calling our department for assistance, knowing that we can respond more quickly than the Sheriff Department. With the merging of the multiple districts, the new Board and Superintendent are publicly announcing their displeasure with the District Police Department and have announced their intentions to dissolve the agency. Essentially, our department is in a fight for its life. We have received backing from Sacramento POA and Sacramento County DSA for our department to stay intact. We have retained Mastagni to assist us in stopping this from happening. Our resources are not large and we are asking for any advice, or monetary assistance to help offset the potentially looming costs that await or future.

February 14, 2008 Meeting- The next meeting will be hosted by the San Joaquin County DSA and is slated to take place on February 14, which also happens to be Valentine's Day. We have run into an issue where restaurants are booked and cannot handle a large group on that particular night. Additionally, we believe attendance will suffer, as our members will choose to enjoy a romantic dinner with their significant others. San Joaquin DSA has tentatively reserved Wednesday, February 13, 2008 at Dave Wongs. I would like to ask for a motion from the floor to move the February meeting ahead one day, so we do not interfere with Valentine's Day.
