Old Business:
Adam Christianson (Sheriff - Stanislaus County):
Wanted to stop by the first meeting of the year to personally thank the Valley Chapter and PORAC for their support during his successful campaign to become the new Sheriff of Stanislaus County. In addition, he said that he will strive to get better pay for his deputies to help retention rates.

Joe Schmit:
Asked if the by-laws permitted those who were not present at a previous Valley Chapter meeting to make a motion and/or vote to approve the minutes of said meeting, saying they were not present to know if the minutes are truly accurate.

A brief discussion was held by the Board of Directors with President Schnepple advising the body that we will look into the matter for clarification.

New Business:
President Schnepple:
Jim Bock has requested that the Valley Chapter purchase a printer that he will be able to bring to each of the meetings. In doing so, it will enable us to provide endorsement letters to candidates and legislation immediately. Additionally, he would be able to print any documents needed immediately upon request during a meeting.

Reports:
Ron Cottingham (PORAC):
Vacation Update - Announced that he and his wife took a vacation as instructed by the PORAC body at the November Conference. (A member present did note that the photo was only of his wife, which was one of the requirements).

GASB 45 - This is going to be a huge tool used to go after pensions this term for the Governor. Howard Jarvis Tax Foundation has already issued a press release regarding unfunded liabilities. The Governor is going to be establishing a committee to look into the pension reform issues. It is believed that several of his contributors will be on this committee. We are waiting to see who he appoints.

  • Randy Beintema:
    The E-Board has taken this issue to heart and is trying to get Ron appointed on this committee. Should this happen, Ron will be working nearly full time. Because of this, the E-Board has taken measures to make sure that PORAC leadership is constant. In the event Ron is appointed to this committee, the E-Board has authorized to bring Vice President Durant up to full-time status to ensure the day to day operations are tended to as Ron works to save our pensions.

Long Term Care - A lot of new information is starting to come out regarding long term care. Feel free to give me a call and I will be happy to send that information out to you.

Gary Messing (Carroll, Burdick & McDonough)
Merced County -
Officer Horn has been getting bad publicity after his canine partner died in the back of his patrol car in Merced. While he was out mourning the loss of his partner, the Department served him with a notice of suspension for 16 working shifts. At the Skelly hearing the Chief brought in the new law regarding tethering animals for extended periods as an argument in support of the suspension. Data was also introduced that showed a car left in 85 degree temperatures for 30 minutes will heat up to 120 degrees on the interior. Every officer called in to testify during the hearing reported that they regularly leave their partners in the patrol vehicle for 30-90 minutes as standard practice and this is the first time a dog has been injured. Horn also said that he has been trying for years to get protective equipment in the car to prevent this type of tragedy from happening, however, the department has turned it down each time. After all of the testimony, the case was reversed in its entirety.

Fresno DSA - Litigated a case in which Fresno DSA will not be allowed to annual leave upon request.

Gary Goyette (Goyette and Associates)
San Francisco -
Currently seeking an approval from LDF to file an appeal to the Supreme Court in a case where an officer's claim was barred for failure to file a tort claim notice.

Oroville - Have a brief scheduled next month regarding a POBOR due process rights case out of Oroville.

Los Angeles - We are currently litigating a case regarding the wages and hours for donning and doffing gear. I have immersed myself in this area and would be happy to answer any questions you have regarding this ruling.
