V. Approval of Minutes

1. Minutes from November 2002 meeting presented by Smith, Motion to accept by Shlenker, Second by Pete Provecial 2nd Paul Brown, motion carried.

VI. Treasurer's report

1. Paul Brown presented report, Valley Chapter account balances: General acct - $12,859.27, PAC Acct - $28,458.45. Motion to accept report by Mark Smith, 2nd Provecial, motion carried

VIII. New Business

1. Smith discussed the proposed by-law amendment. We currently spend approximately $150 per month mailing the newsletter to member associations. Smith pointed out the money savings by converting to a web based notification system instead of US mail. The web page will cost under $100 per year to maintain. We have a web page set up at www.valleychapterporac.org. The proposed by-law amendment will allow the Valley Chapter to post the required meeting notices and minutes on the web page instead of mailing them to member associations. Member associations can still make a request of the board of Valley Chapter to have the minutes and meeting notices mailed to them. The Valley Chapter can charge a fee to recover mailing costs if the boards chooses to. The text of the proposed amendment are included in the attached ballot and are incorporated into these minutes.

IX. Reports

A. PAC

Given by Paul Brown: 2003 Training Calendar is out. Release of Governors State budget is coming up on January 10th. There was a controversy raised over the PORAC President’s election in regards to proxy votes that may have been collected late.

B. Insurance and Benefits

None

C. LDF

Andy Schlenker reported on several cases; A Manhattan Beach Police Officer was aquitted, E Palo Alto Officer reinstated, big cases in San Bernardino and Fontana. Andy had also been re-elected to another two-year term on LDF.

D. Service Provider's Reports

-Beltran reported on the new POBAR amendment regarding departments violeting POBAR. Pointed out in order to show a violation you must prove a malicious intent to injure.

-Rocky Lucia reported on a 148.6 case

E. Association reports

Sacramento POA reported on an issue they have with retirees being hired back.

A short board of directors meeting was conducted after the regular meeting.

A motion was made by Smith for the Valley Chapter to pay for the Valley Chapter Board members to attend the PORAC Symposium. Second by Brown, motion carried.

Proposed By-Law Amendments:

The below listed by-law amendments and additions were proposed at the January Valley Chapter Meeting.   They are incorporated in the January 2003 Minutes.  A vote will be taken on the amendments at the February Chapter meeting in Stockton.

Added to Article I

Section 6. The Chapter is authorized to maintain an Internet web site. Meeting notifications and minutes from past meetings may be maintained on the Internet web site. Meeting notifications and minutes placed on the web site will be deemed to have been delivered to all member associations and organizations. Member associations and organizations wishing to receive meeting notices via regular mail may make a request in writing to the Executive Committee. The Executive Committee is authorized to charge a reasonable fee to recover expenses for associations or organizations requesting meeting notices delivered via regular mail.

Duties of Chapter Officers

Section 3. The Secretary Shall:

A. Keep the minutes of all Chapter Meetings and disseminate them to all member Associations/Organizations in accordance with Article 1, Section 6 of these by-laws.

B. Conduct such correspondence as directed, and maintain such files as are necessary.

C. Shall cause the notice of each meeting date, and location, to be sent made available to each Association/Organization not less than ten (10) days prior to such meeting. This notification may be made in accordance with Article 1, section 6 of these by-laws.
