LA Times v. P.O.S.T. - In a court ruling, P.O.S.T. was ordered to release the names of every police officer hired, or fired between 1995 - 2007. The deadline for this information exchange was initially February 15, 2008. The date was reset to April 18, 2008, however, that date is not set in stone and is tentative.

Maywood Case (S. California) - This case involves FTOs who are accused of excessive force after their trainees were released from employment and subsequently accused their former FTOs of making them falsify police reports. Be wary of this type of action. There are three cases pending regarding this type of behavior from trainees who have been released.

Eureka - This is an interesting case LDF has taken. A woman who was apparently mentally disturbed and in possession of a marine flare gun had locked herself in her house. A SWAT stand off took place. The woman kept moving to the window and looking outside. SWAT decided that the next time the woman went to the window, they would make entry and apprehend the woman by surprise. As SWAT entered the house, the woman turned suddenly and aimed the flare gun at the officers, who subsequently shot. The District Attorney convened a Grand Jury investigation, which resulted in an indictment for manslaughter against a Lieutenant and the retired Police Chief. A change of venue is currently being sought, so a fair trial can be obtained.

Oakland Riders - Despite the fact that all of the officers were cleared criminally and civily, the city is still proceeding with administrative action against the officers.

Status of LDF Fund - Since making the decision to go out of state, LDF has increased to 72,200 members. We just returned from Utah and will soon be heading to Missouri. We continue to expand and now provide LDF in 17 states. PORAC LDF is becoming more of a national plan, which is good to maintain level rates. Nobody can match LDF services. At any one time, we average 15-20 criminal cases.

Dave French (Insurance and Benefits):
Medical Programs - PORAC has extremely competitive rates on Medical through PERS and it continues to grow. As negotiations approach, your associations should look into getting medical through PORAC. PORAC's PPO is very competitive.

Ron Cottingham (PORAC):
P.O.S.T. Advisory Committee - After a lot of work on PORACs part, I am proud to announce that Jim Bock has been appointed to sit on the P.O.S.T. Advisory Committee representing California Specialized Law Enforcement.

University of the Pacific POA - Mike Durant just prior to the Valley Chapter meeting stopped in for a meeting with the University of the Pacific POA in an attempt to recruit them into PORAC.

PEBCO - The Commission on Public Employee Benefits has finished its mission and completed a report consisting of 337 pages. The entire book is available for your review at http://pebc.ca.gov. Once you find the page, simply look for the link to "Final Report". There is a lot of reading, however, if you review the first 17 pages, you will get the condensed version of what the entire manual has to say.

Legislation Cycle - We have entered the legislative cycle and everything is going well. One of the pieces of legislation we are working on this year is including every police officer, who falls under 830 in the jury duty exemption. We will keep you posted.

Randy Beintema:
Proposition 93 - With the recent failure of Prop. 93, approximately 1/3 of the Assembly and Senate will be changing hands, due to term limitations. If you have any persons you wish to be endorsed, it is imperative that you get their names submitted and voted on through your Chapters. In the event that time constraints hit and no endorsement has been made, the legislators may contact PORAC directly. If the Chapters have not provided PORAC with their endorsements at the local level, PORAC may pick the candidate that they believe will best fill that role.

David Mastagni (Mastagni, et. al):
Binding Arbitration - This topic is still going through the courts. However, whenever we get close, the counties/cities provide an offer that settles the contract and the process is halted. Currently, Sierra Madre is paid at a ridiculously low level. As an indicator of how bad their situation and pay is, they have requested in negotiations only to be the lowest paid agency in the county. They are currently seeking a ballot measure that would provide for better pay. The city has offered a contract that asks them to drop their support of the ballot measure and in turn, assist in passing a utility tax. At this time, everything regarding binding arbitration is resting with the outcome of Sierra Madre POA.

RateMyCop.com - This website is currently under development and is claiming that it will be opening at some point in 2008. We are looking to pre-emptively stop this web site from publishing police officer private information for the public to see. The release of this information is much akin to what AJ Munn did a few years ago, in which he would release the name of officers, where their kids attended school, their private addresses and license plate numbers, etc. We will keep you updated on the progress of this issue.

Jason Jasmine (Carol, Burdick & McDonough):
Sacramento County DSA - Sac County is trying to transfer employees to other positions at a loss of pay. The County is saying that the loss in pay is not punitive, but incidental to the new position and therefore claiming that the employees are not entitled to due process.

Association of Orange County Deputy Sheriffs - We are trying to form a statewide coalition to get a half million public employees from all sectors to support and attach to the efforts of the AOCDS.

Association Reports:
Jim Bock (San Joaquin Delta POA):
Stockton Unified Contract Negotiations- Stockton Unified Schools POA just recently ended a successful contract negotiation. As part of a three-year contract, they will receive PERs Public Safety 3%@50 formula and a 14% pay increase. They will also receive any COLAs that are handed down by the state throughout the duration of the contract.

Brent Myer (Sacramento POA):
New Building - The POA is now in its new building and looks forward to hosting the Valley Chapter at the June meeting. On Friday, the 15th of February we will be hosting a dinner for the new Chief of Police.

Rumors - It has come to our attention that rumors have been circulating throughout the valley that Sac POA agreed to giving up 5% of our pay. These rumors are absolutely false. The POA will never agree to take a cut in pay. If your respective agencies inform you of this, it is 100% false.

Crab Feed - The DSA will be hosting a crab feed on February 22, 2008 at the American Legion Hall in Lodi. Tickets are only $40.00. Contact us if you would like to attend.

Retirement Dinner - The DSA will be hosting a retirement dinner for Captain Randy Beintema on April 12, 2008. More information will follow.

William Cho (Grant Schools POA):
Update on Status of Department - The school district contracted with a retired deputy sheriff to contact an audit of our agency. The district has hired a retired deputy sheriff, who is also a resourse officer to conduct an audit on the police department,which we feel is a conflict of interest. We have retained Mastagni's office to help us fight this battle, however, money is extremely tight, as we are a small association. Any financial assistance would be greatly appreciated.
